Suspension, alternative placement, expulsion: different procedures, different rights. Know which one your school means.

Before debating the consequence, confirm whether the school is proposing a suspension, a change in placement, an expulsion recommendation, or another intervention, and get the procedure in writing.”

MIAMI, FL, UNITED STATES, October 21, 2026 /EINPresswire.com/ -- A newly reported Florida school-discipline summary illustrates why families should ask schools to identify the exact action under consideration. Terms such as removal, alternative placement, suspension, and expulsion can describe different procedures, durations, educational settings, and review rights.

According to an October 12 report, Marion County Public Schools recorded 68 alternative placements during roughly the first month of the school year, including 23 expulsions. The reporting says 28 of the 68 alternative placements involved students receiving Exceptional Student Education services or Section 504 accommodations. It does not say that those 28 students were expelled, and the figures should not be combined to make that claim. You can read about it here.

“The label attached to a discipline decision can determine the next question a family needs to ask,” said Keith Altman, Founder and Managing Partner of K Altman Law. “Before debating the consequence, confirm whether the school is proposing a suspension, a change in placement, an expulsion recommendation, or another intervention—and get the procedure in writing.”

Marion County’s policies apply only within that district, and the rules governing any particular student depend on the state, the school district, and the facts involved. The report also does not establish that any individual decision was lawful or unlawful. Its value is narrower: aggregated data can prompt families and schools to check whether everyone is using discipline terms precisely and applying the correct safeguards.

Families can begin by requesting a written notice that names the alleged conduct, cited rule, proposed action, start and end dates, interim educational program, decision-maker, and appeal route. They should preserve original messages, video, assignments, witness information, and disability-related records without editing or redistributing sensitive material unnecessarily.

When a student has an IEP or Section 504 plan, additional questions may arise about behavioral supports, services during removal, manifestation procedures, and whether repeated removals amount to a change in placement. Those safeguards depend on the facts, duration, pattern, and governing law; disability status is neither immunity from discipline nor permission to skip required procedures.

Schools can improve decisions by separating incident findings from placement decisions, documenting alternatives considered, and explaining how education will continue. Families facing serious exclusion may contact K Altman Law for individualized guidance before a hearing or appeal deadline.
